The Controversial Use of the State Secrets Privilege in Venezuelan Migrant Deportations

On Monday, high‑ranking officials—including Attorney General Pam Bondi, Secretary of State Marco Rubio, and Kristi Noem, Secretary of the Department of Homeland Security—invoked the “state secrets privilege” to refuse providing further details to U.S. District Judge James Boasberg about flights deporting Venezuelan migrants to El Salvador under an 18th‑century wartime law. This legal maneuver has sparked intense debate among policymakers, legal scholars, and the public, as it touches on issues of executive authority, national security, and judicial oversight.
